Laws and Legislation
As the threat of Identity Theft continues to rise,
government has reacted by passing laws over the years to protect the privacy of
both businesses and consumers. Government has enacted strict laws and
regulations that affect how an organization must properly store and discard of
sensitive information.
Recent privacy laws like FACTA (credit reporting),
HIPAA (healthcare), and Gramm-Leach-Bliley (financial) require that companies
properly store and destroy all information before it is discarded. An
organizations failure to comply with these laws can result in penalties, fines
and possible a class action law suit.
Other laws such as Sarbanes-Oxley (corporate
governance and operations reform) and Economic Espionage Act (trade secret
protection) require for proper storage and destruction of materials. The
EEA does not protect any company that does not take the proper steps in
discarding proprietary information.
